These Terms and Conditions (“Terms”) apply to the use of the Pixelbrick website (“Site”) and the services provided by Pixelbrick (“we”, “our” or “us”). By accessing or using our Site, you agree to these Terms and agree to comply with them. If you do not agree with these Terms, please do not use the Site.

Pixelbrick is based in the Netherlands, and these Terms are governed by Dutch law.

1. General Information

Pixelbrick allows customers to create personalised brick mosaics using LEGO®-compatible bricks. Users can create their own mosaic designs and order a kit that contains all the necessary bricks and instructions to build it themselves.

2. Use of the Site

2.1 Eligibility: You must be at least 18 years old to use this Site. By using the Site, you confirm that you are at least 18 years old, or that you use the Site under the supervision of a parent or guardian.

2.2 Account creation: You may need to create an account to access certain features of the Site, such as saving designs or placing orders. You agree to provide accurate and complete information when creating your account and to keep your account information up to date.

2.3 Account security: You are responsible for maintaining the confidentiality of your login details and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.

2.4 Site access: We reserve the right to change, suspend or discontinue the Site or any part of the services at any time without prior notice.

3. Products and Services

3.1 Personalised mosaic designs: With the tools offered on the Site, you can design personalised mosaic art. The design may be based on images or artwork that you upload or create on the Site.

3.2 Order process: After completing your design, you can place an order for a kit containing all necessary LEGO®-compatible bricks and instructions to build the mosaic. You are responsible for checking the design before placing the order, and you agree that once an order has been placed, it cannot be changed or cancelled.

3.3 Product availability: All products are subject to availability. If it is not possible to fulfil your order due to unavailable materials, we will inform you as soon as possible and offer a refund or alternative products.

6. Intellectual Property

6.1 Ownership of designs: By submitting your design through the Site, you retain ownership of your original artwork. However, by submitting a design, you grant Pixelbrick a limited, worldwide, royalty-free licence to use, process and reproduce your design and upload(s) solely for:

• fulfilling your order, including production, assembly, quality control and delivery; and
• customer service, for example support with questions, errors or missing parts.

We do not use your design or upload(s) for marketing or promotional purposes, such as social media, advertisements or website examples, without your express consent.

6.2 Site content: All content on the Site, including logos, text, images and software, is the intellectual property of Pixelbrick or its licensors. You may not use, reproduce or distribute any of this content without prior written permission from Pixelbrick.

7. User-Created Content

7.1 Design submissions: You may upload or submit designs on the Site, provided that you comply with all applicable laws and these Terms. By submitting a design, you represent and warrant that you own the rights to the design and that it does not infringe the rights of third parties.

7.2 Content guidelines: You agree not to upload or submit content that:

• violates applicable laws or regulations;
• is offensive, defamatory, obscene, or infringes the rights of others;
• contains malware, viruses or other harmful components.

Pixelbrick reserves the right to remove content that violates these guidelines or our policies. Pixelbrick also reserves the right to refuse, pause or cancel a design or order if, in our reasonable judgement, the content violates these Terms, the law or the rights of third parties.

8. Privacy and Data Protection

8.1 Privacy Policy: Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use and protect your personal data. Please read our Privacy Policy carefully before using the Site.

8.2 Data security: We use reasonable security measures to protect the personal information you provide. However, no data transmission over the internet can be guaranteed to be 100% secure. You acknowledge and accept the risks associated with sending information online.

9. Limitation of Liability

9.1 Indemnification: You agree to indemnify Pixelbrick, its officers, employees and agents against all claims, damages, losses, liabilities or costs arising from your use of the Site or your breach of these Terms.

9.2 Limitation of liability: To the extent permitted by Dutch law, Pixelbrick’s liability for damages, including indirect, incidental, special or consequential damages, is limited to the amount you paid for the relevant product. We are not liable for damages resulting from the use of, or inability to use, the Site, including loss of profit or data.

10. Termination

We reserve the right to suspend or terminate your access to the Site at our sole discretion, without notice, for breach of these Terms or for any other reason. Upon termination, you must immediately stop using the Site.

11. Changes to the Terms

Pixelbrick reserves the right to update or change these Terms at any time. We will post the updated Terms on the Site, and the amended Terms will take effect immediately after posting. Your continued use of the Site after changes to these Terms constitutes your acceptance of the new Terms.

12. Governing Law and Dispute Resolution

12.1 Governing law: These Terms are governed by and interpreted in accordance with the laws of the Netherlands.

12.2 Dispute resolution: Any disputes arising from or relating to these Terms will be resolved by the competent courts in the Netherlands. Before starting formal legal proceedings, you agree to try to resolve any disputes peacefully through communication with Pixelbrick.
